Scope & Operating Legal Entity

These Commercial Terms & Conditions ("Terms") apply to all technical consultations, price quotations, CAD technical data packages, manufacturing orders, and equipment deliveries executed by:

By requesting an engineering quotation, downloading technical drawings, or placing a purchase order, the purchasing entity ("Buyer") agrees to be bound by these Terms unless explicitly superseded by a mutually signed Master Supply Agreement.

Online Sizing Tools & Technical Disclaimers

The online Accumulator Sizing Calculator provided on this website is an engineering convenience tool based on standard gas laws ($p_0 V_0^n = \text{const}$).

Preliminary Sizing Disclaimer: Results generated online serve as preliminary guidance estimates only. Operating parameters—including real-gas compressibility factors ($Z$) above 35 MPa, dynamic polytropic exponent variations ($n$), fluid piping pressure drops, and rapid cyclic heating—require formal technical review by Schwerll applications engineers prior to equipment fabrication.

Schwerll assumes no legal liability for equipment specified solely through self-directed use of the online calculator without formal written engineering confirmation.

Quotations, Commercial Validity & Delivery

  • Validity Period: Formal written price tenders remain valid for thirty (30) calendar days from issuance, subject to market fluctuations in forged alloy raw materials.
  • Incoterms & Freight: Unless stated otherwise in the commercial proforma invoice, standard delivery terms are FOB Tianjin/Shanghai Port or CIF/DAP to designated international seaports and airports in accordance with Incoterms 2020.
  • Export Packaging: Products are packaged in compliance with international export standards (fumigated wooden crates, internal anti-corrosion VCI barrier bags, and protective flange end-caps).

Pressure Vessel Codes & Factory Acceptance (FAT)

All accumulators and pressure bottles are fabricated under strict compliance with the jurisdictional code specified in the purchase contract:

  • Testing Documentation: Each delivered vessel is accompanied by manufacturer inspection certificates, Material Test Reports (MTR / EN 10204 3.1), and hydrostatic pressure test logs.
  • Third-Party Inspection: Factory Acceptance Testing (FAT) witnessed by independent inspection agencies (e.g., SGS, TÜV, DNV, ABS, Lloyd’s Register) is supported upon contractual agreement.

Warranty & Replacement Spares Support

  • Structural Shell Warranty: Pressure shells and structural forged steel barrels are warranted against metallurgical defects for twelve (12) months from commissioning or eighteen (18) months from bill of lading date, whichever occurs first.
  • Consumable Components: Elastomer bladders, diaphragms, and dynamic piston seals are normal wear parts. Schwerll maintains dedicated inventory of genuine OEM seal kits and charging adapters for rapid global air dispatch.
  • Warranty Exclusions: Damage resulting from unauthorized field modification, exceeding stamped design pressures, fluid media contamination, or improper gas pre-charge procedures is excluded from warranty coverage.

Intellectual Property & Confidentiality

All technical drawings, sizing algorithms, 3D CAD STEP files, and custom manifold block designs developed by Schwerll remain the exclusive intellectual property of Schwerll. Buyer receives a non-exclusive license to utilize drawings solely for system integration. Bilateral Non-Disclosure Agreements (NDAs) executed between parties take precedence regarding confidential project schematics.

Limitation of Liability & Force Majeure

To the maximum extent permitted by applicable commercial law, Schwerll’s aggregate financial liability under any contract shall not exceed the net purchase price paid for the specific equipment item giving rise to the claim. In no event shall Schwerll be liable for indirect, incidental, consequential plant downtime, or lost business profits. Standard Force Majeure provisions apply to global supply chain disruptions.

Governing Law & Dispute Resolution

International supply contracts shall be governed by international commercial trading practices and the United Nations Convention on Contracts for the International Sale of Goods (CISG). Any disputes that cannot be amicably settled through direct executive consultation shall be referred to arbitration under internationally recognized commercial arbitration rules.
